The Non-Domestic Rating (Alteration of Lists and Appeals) (Wales) Regulations 2005

The National Assembly for Wales makes the following Regulations in exercise of the powers conferred on the Secretary of State by the following provisions of the Local Government Finance Act 1988(1) and now vested in it, and after consultation with the Council on Tribunals as required by section 8 of the Tribunals and Inquiries Act 1992(2) —

  • sections 42(5), 53(5), 55(2) to (6) and (7A), 143(1) and (2); paragraph 2(6A) of Schedule 6; paragraphs 10 to 12 of Schedule 7A; paragraph 6(1A) of Schedule 9; and paragraphs 1, 4, 5, 6, 8, 11, 12 and 14 to 16 of Schedule 11:

1988 c. 41. Section 55(7A) and paragraph 6(1A) of Schedule 9 were inserted by paragraph 30(5) and 47 of Schedule 5 to the Local Government and Housing Act 1989 (c. 42). Paragraph 2(6A) was inserted by the Local Government and Housing Act 1989 and substituted by paragraph 4 of Schedule 10 to the Local Government Finance Act 1992 (c. 14). These powers were devolved, in relation to Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), see the reference to the Local Government Finance Act 1988 in Schedule 1.
