The Asylum and Immigration (Treatment of Claimants etc.) Act 2004 (Commencement) (Scotland) Order 2004

The Scottish Ministers, in exercise of the powers conferred by section 48(3) of the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004(1) hereby make the following Order:

Citation and extent

1.—(1) This Order may be cited as the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004 (Commencement) (Scotland) Order 2004.

(2) This Order extends to Scotland only.

Commencement

Sections 4 and 5 of the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004 shall come into force on 1st December 2004.

Explanatory Note

(This note is not part of the Order)

This Order, which extends to Scotland only, brings into force on 1st December 2004 sections 4 and 5 of the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004.

Section 4 creates a new offence of trafficking people for exploitation. Section 5 makes supplementary provision in respect of section 4 and adds the new offence to Schedule 4 (Lifestyle Offences – Scotland) to the Proceeds of Crime Act 2002 (c. 29).
