This Order, which extends to Scotland only, makes provision for exemption from the prohibition, under section 20 of the Clean Air Act 1993, of the emission of smoke in smoke control areas.
The Order exempts those fireplaces described in the Schedule which comply with the conditions specified in respect of those fireplaces from the prohibition under section 20 (article 2).
The Order revokes (article 3) and re-enacts the Smoke Control Areas (Exempt Fireplaces) (Scotland) Order 2007. The Order also provides for additional fireplaces to be exempt. The additional entries in the Schedule are entries 5 8, 10 12, 15 25, 27, 28, 29 (partly), 34 39, 41 43, 45, 46 (partly) and 53.
