1.—(1) This Order may be cited as the National Health Service (Functions of the Common Services Agency) (Scotland) Order 2008 and comes into force on 1st October 2008.
(2) In this Order–
“the Act” means the National Health Service (Scotland) Act 1978;
“the Agency” means the Common Services Agency for the Scottish Health Service constituted under section 10(1) of the Act(1);
“Health Board” means a Health Board constituted under section 2(1)(a) of the Act(2);
“pharmaceutical services” has the meaning ascribed to it by section 27(1) of the Act(3);
“the Scottish Dental Practice Board” means the Board constituted under section 4(1) of the Act(4);
“Special Health Board” means a Special Health Board constituted under section 2(1)(b) of the Act(5).
Section 10(1) was amended by the 1980 Act, Schedule 6, paragraph 2.
Section 2(1)(a) was amended by the 1983 Act, section 14(2) and Schedule 7, paragraph 1, the 1990 Act, section 28(a)(i) and the 2005 Act, section 42(1) and schedule 2, paragraph 2(2).
Subsection (1) of section 27 was amended by the 1980 Act, section 20(2), the 1990 Act, Schedule 9, paragraph 19(7)(a), the Medicinal Products: Prescription by Nurses etc. Act 1992 (c. 28), section 3, the National Health Service (Primary Care) Act 1997 (c. 46), Schedule 2, Part I, paragraph 44, and the Health and Social Care Act 2001 (c. 15), section 44(2); subsections (1A) and (1B) were inserted by the Health and Social Care Act 2001 (c. 15), sections 44(3) and 44(3); subsections (2) to (6) were amended by the National Health Service (Amendment) Act 1986 (c. 66), section 3(3); subsection (2) was also amended by the 1990 Act, Schedule 9, paragraph 19(7)(b); subsection (4) was also amended by S.I. 1987/2202, 2007/289 and the 1990 Act, section 66(1) and Schedule 9, paragraph 19(17)(c) and (d).
Section 4(1) was amended by the Health and Medicines Act 1988 (c. 49), section 12(1) to provide that the Scottish Dental Estimates Board be renamed the Scottish Dental Practice Board.
Section 2(1)(b) was amended by the 1990 Act, section 28(a)(ii) and the 2005 Act, section 42(1) and schedule 2, paragraph 2(2).
