The Scottish Ministers make the following Order in exercise of the powers conferred by section 29(1) and (4) of the National Lottery etc. Act 1993(1) and all other powers enabling them to do so.
The Secretary of State has agreed to the making of this Order in accordance with article 2 of, and Schedule 1 to, the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 1999(2).
1993 c.39; relevant modifications are contained in the Scotland Act 1998 (Modification of Functions) Order 1999 (S.I. 1999/1756). The functions of the Secretary of State were transferred in certain circumstances to the Scottish Ministers by virtue of article 2 of and Schedule 1 to the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 1999 (S.I. 1999/1750).
S.I. 1999/1750; those provisions provide that the functions of the Secretary of State under section 29(1) and (4) of the National Lottery etc. Act 1993, as read with section 29(6)(c) and (d) of that Act, are exercisable by the Scottish Ministers with the agreement of the Secretary of State.
