43 Registering of memorials, &c. where assurance, &c. executed before commencement of Act, &c

Where in any case any assurance or instrument executed or made before the passing of this Act, or the will of any testator dying before the commencement of this Act, or any judgment, statute, or recognizance given, acknowledged, or made before the commencement of this Act, or any memorial thereof respectively, might but for the passing of this Act have been registered in any existing registry, but such assurance, instrument, will, judgment, statute, recognizance, or memorial have not been so registered, such assurance, instrument, will, judgment, statute, or recognizance may be registered in the manner and subject to the regulations contained in this Act, and every such registration shall be deemed to be a registering of such assurance, instrument, will, judgment, statute, or recognizance, or of a memorial thereof, under such of the Acts by this Act repealed as apply to the existing registry in which the same might have been so registered as aforesaid, and shall have effect accordingly, but such registration shall not be deemed to be or have effect as a registration of an assurance, instrument, or will under this Act.
