The Secretary of State for Transport (being the appropriate Minister under section 14(7) of the Harbours Act 1964(1) for the purposes of making this Order) in exercise of the powers conferred by section 14 of that Act and now vested in him(2), and of all other powers enabling him in that behalf, and on the application of the Aberdeen Harbour Board, hereby makes the following Order:

Citation and commencement

1.—(1) This Order may be cited as the Aberdeen Harbour Revision Order 1990 and shall come into force on the date fixed in accordance with the provisions of the Statutory Orders (Special Procedure) Acts 1945 and 1965(3).

(2) The Aberdeen Harbour Orders 1960 to 1987 and this Order may be cited together as the Aberdeen Harbour Orders 1960 to 1990.

Interpretation

2.  In this Order “the Order of 1960” means the Aberdeen Harbour Order 1960(4).

Amendment of Order of 1960

3.  The First Schedule to the Order of 1960 shall be amended by adding, at the end of paragraph 1, the following paragraph—

1A.  If an organisation which is referred to in any of paragraphs (a) to (f) of section 3(3) of the Aberdeen Harbour Order 1987(5) ceases to exist, the appointment under that paragraph shall be made by the Secretary of State after consultation if he considers it necessary or desirable with such persons as appear to him to be representative of the interest in question.

Explanatory Note

(This note is not part of the Order)

Paragraphs (a) to (f) of section 3(3) of the Aberdeen Harbour Order 1987 require the Secretary of State to consult with certain named organisations before making appointments to the Aberdeen Harbour Board. Due to the fact that two of those organisations have ceased to exist after the making of that Order, those provisions are amended to enable the Secretary of State to make appointments under any paragraph where an organisation has ceased to exist after consultation if appropriate with such other persons appearing to him to be representative of the interests the paragraph in question relates to.

The Order being subject to special parliamentary procedure, the provisions of the Statutory Orders (Special Procedure) Acts 1945 and 1965 determine the date upon which it comes into force.

The applicants for this Order are the Aberdeen Harbour Board, Harbour Office, 16 Regent Quay, Aberdeen AB9 1SS.
