The Minister of Agriculture, Fisheries and Food, the Secretaries of State respectively concerned with agriculture in Scotland and in Wales and the Department of Agriculture for Northern Ireland, acting jointly, in exercise of the powers conferred by sections 40 and 129(1) and (5) of the Medicines Act 1968(1) and now vested in them(2), and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by the following Regulations in accordance with section 129(6) of that Act and with the consent of the Treasury in accordance with section 40(7) of that Act, and the Secretary of State and the Minister of Agriculture, Fisheries and Food, being Ministers designated(3) for the purposes of section 2(2) of the European Communities Act 1972(4) in relation to medicinal products and the common agricultural policy of the European Community, acting jointly, in exercise of the powers conferred on them by the said section 2(2), hereby make the following Regulations:

Title and commencement

1.  These Regulations may be cited as the Medicines (Medicated Animal Feeding Stuffs) (Amendment) Regulations 1995 and shall come into force on 7th April 1995.

Amendment of the Medicines (Medicated Animal Feeding Stuffs) (No. 2) Regulations 1992

2.—(1) The Medicines (Medicated Animal Feeding Stuffs) (No. 2) Regulations 1992(5) shall be amended in accordance with the following paragraphs.

(2) In regulation 3(11)—

(a)for the words “1st October” there shall be substituted the words “1st July”; and

(b)for the words “1st September” there shall be substituted the words “1st June”.

(3) For Schedule 3 there shall be substituted the Schedule set out in the Schedule to these Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Medicines (Medicated Animal Feeding Stuffs)(No. 2) Regulations 1992 (“the principal Regulations”).

The main changes made by the Regulations are that they alter the fees payable in respect of the entry or retention in, or restoration to, the Register of Manufacturers of Animal Feeding Stuffs (“the Register”) (regulation 2(3) and the Schedule). The new fees are annual. These replace the previous fees which were specially adjusted last year to take into account the change in the commencement of the registration year.

Other changes are made to regulation 3(11) of the principal Regulations. These change the latest date by which a certified copy of the Register has to be supplied to the Minister and the latest certification date of such copy. A copy of the Register must now be supplied to the Minister on or before 1st July in every year (previously 1st October), and must be certified as being a true copy of the Register as at a date not later than 1st June (previously 1st September) in the year in question (regulation 2(2)).

A Compliance Cost Assessment has been prepared and a copy has been placed in the library of each House of Parliament and copies can be obtained from the Veterinary Medicines Directorate, Woodham Lane, Addlestone, Surrey, KT15 3NB.
