The Chancellor of the Exchequer, in exercise of the powers conferred by section 5(1) and (2) of, and paragraph 1 of Schedule 3 to, the Public Expenditure and Receipts Act 1968() and now vested in him() and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and interpretation
1.—(1) This Order may be cited as the Registration of Births, Deaths and Marriages (Fees) (Amendment) Order 2005 and shall come into force on 5th December.
(2) In this Order—
(a)“the principal Order” means the Registration of Births, Deaths and Marriages (Fees) Order 2002(); and
(b)a reference to a numbered column is to the column in the Schedule to the principal Order bearing that number.
Amendment of the principal Order
2. In the Schedule to the principal Order the entries made in respect of the Marriage Act 1949 are amended as follows—
(a)in the entry relating to section 27(7) (attendance of superintendent registrar other than at his office etc), in column (4), for “£40.00” substitute “£47.00”;
(b)in the entry relating to section 51(1) (fee of registrar for attending marriage), in column (4), for “£34.00” and “£40.00” substitute respectively “£40.00” and “£47.00”; and
(c)in the entry relating to section 51(2) (fee of superintendent registrar attending marriage etc), in column (4), for “£40.00” substitute “£47.00”.

Explanatory Note
This Order amends the Registration of Births, Deaths and Marriages (Fees) Order 2002 by increasing some of the fees payable in respect of a civil marriage.
The fees increased are those—
(a)for the attendance of a superintendent registrar away from his office, to take a notice marriage from a housebound or detained person (from £40 to £47),
(b)for the attendance of a registrar of marriages at a marriage in a register office (from £34 to £40), and
(c)for the attendance of a superintendent registrar and a registrar of marriages at a marriage at the residence of a house-bound or detained person (from £40 to £47 each).
This Order does not impose a charge on business.
