The Northern Ireland Act 2009 (Commencement No.2) Order 2010

The Secretary of State, in exercise of the powers conferred by section 5(7) of the Northern Ireland Act 2009(1), makes the following Order:

1.  This Order may be cited as the Northern Ireland Act 2009 (Commencement No.2) Order 2010.

2.  Those provisions of the Northern Ireland Act 2009 that are not already in force shall come into force on the 12th April 2010.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force those provisions of the Northern Ireland Act 2009 (‘the Act’) that are not already in force on 12th April 2010.

Those provisions are section 2 (Judicial appointments and removals), in so far as it is not already in force, section 3(1) (Miscellaneous amendments) and Schedules 2 (Sections 12 to 12C of the Judicature (Northern Ireland) Act 1978), 3 (Amendments to the Justice (Northern Ireland) Act 2002), 4 (Transfer of appointment and related functions) in so far as it is not already in force, 5 (Consequential amendments and transitional provision) and 6 (Review of arrangements for judicial appointments and removals etc.).

Sections 1 (Northern Ireland department with policing and justice functions), 3(2) (Miscellaneous amendments), 4 (Amendments to section 86 of the Northern Ireland Act 1998) and 5 (Final provisions) and Schedule 1 (Northern Ireland department with policing and justice functions) were brought into force on the day on which the Act was passed.

Paragraph 35(1) and (3) of Schedule 4, in so far as they relate to the President or other member of the Charity Tribunal for Northern Ireland and section 2(3) so far as it relates to those provisions as aforementioned, were brought into force on 26th September 2009.
