This Order is the seventh commencement order made under the Criminal Justice and Courts Act 2015 (c. 2) (“the Act”).
Article 2 brings into force section 66 of the Act, which amends the Special Immigration Appeals Commission Act 1997 (c. 68) to make provision for appeals (known as “leapfrog” appeals) from final determinations of the Special Immigration Appeals Commission (“the Commission”) to the Supreme Court if certain conditions are met.
Article 3 provides that amendments made by section 66 of the Act do not apply to a final determination made by the Commission before section 66 comes into force, so that only final determinations made on or after that date may be the subject of a “leapfrog” appeal.
