The B1448 Trunk Road (Topcliffe Road, Thirsk) (Detrunking) Order 2019

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10(2) and 12(3) of the Highways Act 1980(1) and now vested in the Secretary of State(2):-

1.  This Order may be cited as the B1448 Trunk Road (Topcliffe Road, Thirsk) (Detrunking) Order 2019 and shall come into force on 26th July 2019.

2.  In this Order:-

(i)“the plan”

means the plan numbered HE/10/OD/002, marked “The B1448 Trunk Road (Topcliffe Road, Thirsk) (Detrunking) Order 2019”, signed by authority of Secretary of State for Transport and deposited at Communities and Local Government, Deposited Document Services, Room F13, Ashdown House, St Leonards on Sea, Hastings, East Sussex,

TN37 7GS;

(ii)“classified road”as a classification for a highway, means that the highway is not a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads; and
(iii)“the trunk road”means the length of the trunk road described in the Schedule to this Order, in the District of Hambleton in the County of North Yorkshire.

3.  The trunk road shall cease to be a trunk road and shall be classified as a classified road as from the date on which this Order comes into force.

Regulation 2

SCHEDULELENGTH OF THE TRUNK ROAD CEASING TO BE TRUNK ROAD

The length of the trunk road ceased to be a trunk road is the new length of the B1448 Topcliffe Road from its junction with the northern roundabout at the junction of the A168 Trunk Road and B1448 northwards for a distance of 91 metres, as shown by heavy black hatching on the plan.

EXPLANATORY NOTE

(This note is not part of the Order)

The junction of the A168 Trunk Road and the B1448 has been reconfigured to include a new dumbbell roundabout arrangement, altering the line of the B1448 Topcliffe Road, connecting with the new northern roundabout. The purpose of the Order is to authorise the Secretary of State to remove the trunk road status from the length of the trunk road described in the Schedule to the Order, the responsibility for the maintenance of which will thereafter pass to the local Highway Authority, North Yorkshire County Council.
