Sefydlu Pwyllgorau Ymchwilio

3.—(1) Rhaid i'r Cyngor sefydlu un neu ragor o bwyllgorau i'w galw'n Bwyllgorau Ymchwilio er mwyn cyflawni'r swyddogaethau y cyfeirir atynt ym mharagraff (2).

(2) Swyddogaethau Pwyllgor Ymchwilio yw—

(a)cynnal unrhyw ymchwiliadau a welant yn dda mewn achosion—

(i)pan honnir bod athro neu athrawes gofrestredig yn euog o ymddygiad proffesiynol annerbyniol neu anghymhwysedd proffesiynol difrifol, neu eu bod wedi'u collfarnu (ar unrhyw adeg) o dramgwydd perthnasol, neu

(ii)pan yw'n ymddangos iddynt y gall athro neu athrawes gofrestredig fod yn euog fel hyn neu wedi'u collfarnu fel hyn; a

(b)penderfynu, yng ngoleuni eu hymchwiliadau—

(i)a oes gan athro neu athrawes gofrestredig achos i'w ateb mewn perthynas ag ymddygiad proffesiynol annerbyniol neu gollfarn am dramgwydd perthnasol, ac a ddylai'r achos gael ei gyfeirio at Bwyllgor Ymddygiad Proffesiynol ar gyfer dyfarniad,

(ii)a oes gan athro neu athrawes gofrestredig achos i'w ateb mewn perthynas ag anghymhwysedd proffesiynol difrifol, ac a ddylai'r achos gael ei gyfeirio at Bwyllgor Cymhwysedd Proffesiynol ar gyfer dyfarniad,

(iii)a oes gan athro neu athrawes gofrestredig achos i'w ateb mewn perthynas ag ymddygiad proffesiynol annerbyniol neu gollfarn am dramgwydd perthnasol ac mewn perthynas ag anghymhwysedd proffesiynol difrifol, ac a ddylai'r achos gael ei gyfeirio at naill ai Pwyllgor Ymddygiad Proffesiynol neu Bwyllgor Cymhwysedd Proffesiynol ar gyfer dyfarniad, fel y gwelant yn dda,

(iv)a oes gan athro neu athrawes gofrestredig ddim achos i'w ateb ac y dylai'r achos yn eu herbyn gael ei ollwng, neu

(v)a ddylai'r achos yn erbyn athro neu athrawes gofrestredig gael ei ollwng ar sail arall.
