Gwahardd neu gyfyngu pwerau Pwyllgorau

9.—(1) Mae swyddogaethau Pwyllgor Ymchwilio o dan y Rheoliadau hyn wedi eu gwahardd mewn achos—

(a)pan honnir bod athro neu athrawes gofrestredig yn euog o ymddygiad proffesiynol annerbyniol neu eu bod wedi'u collfarnu (ar unrhyw adeg) o dramgwydd perthnasol, neu pan yw'n ymddangos iddynt y gall athro neu athrawes gofrestredig fod yn euog fel hyn neu wedi'u collfarnu fel hyn; ond

(b)bod y Cynulliad Cenedlaethol neu'r Ysgrifennydd Gwladol yn dymuno ystyried yr achos gyda'r bwriad o arfer ei bwerau a roddwyd gan reoliadau a wnaed o dan adran 218(6) o Ddeddf Diwygio Addysg 1988(1) oherwydd ei fod yn codi materion ynghylch diogelwch a lles personau o dan 19 oed.

(2) Mae swyddogaethau Pwyllgor Ymchwilio o dan y Rheoliadau hyn wedi eu gwahardd mewn achos

(a)pan honnir bod athro neu athrawes gofrestredig yn euog o anghymhwysedd proffesiynol difrifol neu pan yw'n ymddangos iddynt y gall athro neu athrawes gofrestredig fod yn euog fel hyn; ond

(b)nad oes gwybodaeth wedi'i rhoi i'r Cyngor yn unol â rheoliad 28 mewn perthynas â'r athro hwnnw neu'r athrawes honno.

1988 p.40. Diwygiwyd adran 218(6) gan adran 290(3) o Ddeddf Addysg 1993 (p.35) a chan adran 5(4) o Ddeddf Amddiffyn Plant 1999 (p.14). Y rheoliadau a oedd mewn grym adeg gwneud y rheoliadau hyn oedd Rheoliadau Addysg (Cyfyngu Cyflogaeth) 2000, O.S. 2000/2419, sy'n gymwys i Gymru a Lloegr.
