Amendment of the Inspection of Education and Training (Wales) Regulations 2001

2.—(1) The Inspection of Education and Training (Wales) Regulations 2001(1) are amended as follows.

(2) For regulation 2 substitute the following —

“2.   Inspections are to be conducted within —

(a) six years of the date of the last inspection, or

(b) where there has been no inspection, within six years of whichever is the earlier of—

(i) the date of any assessment or inspection carried out under section 9(4) of the Further and Higher Education Act 1992(2);

(ii) the date of establishment of an institution providing education and training to be inspected; or

(iii) 1st September 2004,

and then within each six year period of the date of the last inspection.”.

(3) In regulation 3 —

(a) for the number “55” substitute the number “70”, and

(b) delete the words “ or, where it is necessary to provide a translation into Welsh or English, the period of 65 working days from that date”.

(4) In regulation 4(1) —

(a) for the number “40” substitute the number “50”, and

(b) delete the words “or, where it is necessary to provide a translation into Welsh or English, the period of 50 working days” and the words “(in either case)”.
