Changes to Legislation
Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Pŵer i ddyroddi codau arferion a argymhellirLL+C
6.—(1) Fel canllawiau i awdurdodau bwyd anifeiliaid ac awdurdodau bwyd, caiff y Cynulliad ddyroddi codau arferion a argymhellir ynghylch—
(a)swyddogaethau a roddwyd i'r awdurdodau hynny yn rhinwedd eu swyddogaeth fel awdurdodau cymwys gan neu o dan Reoliad 882/2004; neu
(b)gweithredu a gorfodi Rhan III o'r Rheoliadau hyn.
(2) Caiff yr Asiantaeth, ar ôl ymgynghori â'r Cynulliad, roi cyfarwyddyd i awdurdod bwyd anifeiliaid neu awdurdod bwyd yn ei gwneud yn ofynnol iddo gymryd unrhyw gamau penodedig er mwyn cydymffurfio â chod a ddyroddir o dan y rheoliad hwn.
(3) Wrth arfer y swyddogaethau a roddwyd iddynt fel awdurdodau cymwys gan neu o dan Reoliad 882/2004, rhaid i bob awdurdod bwyd anifeiliaid ac awdurdod bwyd—
(a)rhoi sylw i unrhyw ddarpariaeth berthnasol mewn unrhyw god o'r fath; a
(b)cydymffurfio ag unrhyw gyfarwyddyd a roddir o dan y rheoliad hwn ac sy'n ei gwneud yn ofynnol iddynt gymryd unrhyw gamau penodedig er mwyn cydymffurfio â'r cod hwnnw.
(4) Bydd unrhyw gyfarwyddyd o dan baragraff (2), ar gais yr Asiantaeth, yn gyfarwyddyd y gellir ei orfodi drwy orchymyn mandadol.
(5) Rhaid i'r Asiantaeth ymgynghori â'r Cynulliad cyn gwneud cais o dan baragraff (4).
(6) Cyn dyroddi unrhyw god o dan y rheoliad hwn, bydd y Cynulliad yn rhoi sylw i unrhyw gyngor perthnasol a roddir gan yr Asiantaeth.
