The National Assembly for Wales being the appropriate person for the purposes of section 79(7C)(d) of the Environmental Protection Act 1990 (“the 1990 Act”)(1), makes the following Regulations in exercise of those powers and in exercise of the powers conferred upon the Secretary of State and which are now exercisable by the National Assembly for Wales, under paragraph 1(4) of Schedule 3 to that Act(2):

1990 c. 43; the definition of “appropriate person” in section 79(7) was inserted by section 101(4) of the Clean Neighbourhoods and Environment Act 2005 (c. 16), and section 79(7C) was inserted by section 101(5) of that Act.

The relevant functions of the Secretary of State in relation to Wales were transferred to the National Assembly for Wales by article 2(a) of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).
