The Tuberculosis (Testing and Powers of Entry) (Wales) Order 2008

The Welsh Ministers in exercise of the powers conferred on them by section 62D of the Animal Health Act 1981 (1) make the following Order—

A draft of this Order was laid before the National Assembly for Wales under section 62D of the Animal Health Act 1981 and has been approved by a resolution of the National Assembly for Wales.

Title, commencement and application

1.  The title of this Order is the Tuberculosis (Testing and Powers of Entry) (Wales) Order 2008; it applies in relation to Wales and comes into force on the day after it is made.

Specification of “disease”

2.  Tuberculosis is specified as a disease (“clefyd”) for the purpose of section 62D (tests and samples: power of entry) of the Animal Health Act 1981.

Explanatory Note

(This note is not part of the Order)

This Order specifies tuberculosis as a disease for the purposes of section 62D of the Animal Health Act 1981.

1981 c. 22. S.I. 2004/3044 transferred the functions of the Secretary of State under section 62D of the Act to the National Assembly for Wales. By virtue of section 162 of and paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (2006 c. 32) these functions are exercisable by the Welsh Ministers.
