Diystyru rhai buddiannau a gwelliannau
19.—(1) Wrth asesu'r iawndal (os oes iawndal) sy'n daladwy i unrhyw berson yn dilyn caffael unrhyw dir oddi ar y person hwnnw o dan y Gorchymyn hwn, rhaid i'r tribiwnlys beidio â chymryd i ystyriaeth—
(a)unrhyw fuddiant mewn tir, neu
(b)unrhyw ychwanegiad at werth unrhyw fuddiant mewn tir o ganlyniad i unrhyw adeilad a godwyd, gweithiau a gyflawnwyd, neu welliant neu newid a wnaed ar dir perthnasol,
os bodlonir y tribiwnlys nad oedd yn rhesymol angenrheidiol creu'r buddiant, codi'r adeilad, cyflawni'r gweithiau neu wneud y gwelliant neu newid, ac yr ymgymerwyd ag ef gyda golwg ar gael iawndal neu gynyddu iawndal.
(2) Ym mharagraff (1) ystyr “tir perthnasol” (“relevant land”) yw'r tir a gaffaelwyd oddi ar y person dan sylw neu unrhyw dir arall y mae'r person hwnnw'n ymwneud ag ef, yn uniongyrchol neu'n anuniongyrchol, neu yr oedd yn ymwneud ag ef felly ar yr adeg y codwyd yr adeilad, y cyflawnwyd y gweithiau neu y gwnaed y gwelliant neu'r newid.
