5. Rhaid i wrth-hysbysiad gynnwys (yn ychwanegol at y datganiad y cyfeirir ato yn adran 84(2)(a) a (b) (gwrth-hysbysiadau) o Ddeddf 2002)—
(a)datganiad y caiff y cwmni RTM, os cafodd y cwmni un gwrth-hysbysiad neu fwy sy'n cynnwys datganiad a grybwyllir yn adran 84(2)(b) o Ddeddf 2002, wneud cais i dribiwnlys prisio lesddaliad am benderfyniad bod gan y cwmni, ar y dyddiad y rhoddwyd yr hysbysiad o hawliad, hawlogaeth i gaffael yr hawl i reoli'r fangre a bennwyd yn yr hysbysiad hawlio;
(b)datganiad nad yw'r cwmni RTM, os yw wedi cael un gwrth-hysbysiad neu fwy sy'n cynnwys datganiad a grybwyllir yn adran 84(2)(b) o Ddeddf 2002, yn caffael yr hawl i reoli'r fangre a bennwyd yn yr hysbysiad hawlio oni bai—
(i)y penderfynir yn derfynol(1) pan wneir cais i dribiwnlys prisio lesddaliad fod gan y cwmni hawlogaeth i gaffael yr hawl i reoli'r fangre; neu
(ii)bod y person a roddodd y gwrth-hysbysiad, neu'r personau a roddodd y gwrth-hysbysiadau, yn cytuno, mewn ysgrif, fod gan y cwmni yr hawlogaeth honno; ac
(c)yr wybodaeth a ddarperir yn y nodiadau i'r ffurflen a nodir yn Atodlen 3 i'r Rheoliadau hyn.
