NODYN ESBONIADOL

Mae’r Rheoliadau hyn wedi eu gwneud o dan bwerau yn Neddf Newid yn yr Hinsawdd 2008 ac maent yn diwygio Rheoliadau Codi Tâl am Fagiau Siopa Untro (Cymru) 2010 (O.S. 2010/2880 (Cy. 238)) (“Rheoliadau 2010”).

Mae Rheoliadau 2010, yn ddarostyngedig i esemptiadau penodol, yn ei gwneud yn ofynnol i werthwyr nwyddau sy’n cyflenwi bagiau siopa untro at ddiben caniatáu i’r nwyddau hynny gael eu cludo ymaith neu eu danfon godi tâl am bob bag a gyflenwir.

Mae rheoliad 3 o’r Rheoliadau hyn yn diwygio Atodlen 1 (Esemptiadau) i Reoliadau 2010, drwy fewnosod darpariaeth newydd i esemptio bagiau a ddefnyddir i gludo nwyddau a brynir i’w danfon yn rhan o wasanaeth danfon nwyddau groser, neu i’w casglu yn rhan o wasanaeth sy’n darparu ar gyfer casglu nwyddau groser, rhag y tâl. Gweithredir yr esemptiad newydd yn ddarostyngedig i derfyn amser o dri mis.

Diben yr esemptiad dros dro yw cynyddu effeithlonrwydd systemau danfon, a lliniaru cyhyd ag y bo modd, y risg o drosglwyddo feirws COVID-19 (coronafeirws) drwy systemau danfon a chasglu, drwy ddefnyddio bagiau siopa untro i gludo nwyddau.

Oherwydd natur frys yr offeryn ni fu’n bosibl llunio Asesiad Effaith Rheoleiddiol a’r Effaith ar Fusnes. Er hynny, mae anghenion busnesau ac, yn benodol, y sector manwerthu wedi llywio i raddau helaeth y gwaith o baratoi’r Rheoliadau hyn.
