Article 40Powers of the Boards of Appeal

One or more Boards of Appeal shall be established within the Agency.

The Board or Boards of Appeal shall be responsible for deciding on appeals against the decisions referred to in Article 44.

The Board or Boards of Appeal shall be convened as necessary. The number of boards of Appeal and the work allocated to it or them shall be determined by the Commission acting in accordance with the procedure referred to in Article 65(3).
