Article 3 U.K. Eligibility of simple programmes

1. To be eligible, the simple programmes shall:

(a) comply with [F1 retained EU law] governing the products concerned and their marketing;

[F3 (c) relate to the promotion of United Kingdom agricultural products, both in terms of content of the message and impact. In particular it must provide information on production standards, the quality and safety of food products and dietary practices and culture, promote the image of United Kingdom products both within the United Kingdom and abroad, raise awareness of United Kingdom products and logos among the general public and commercial undertakings. This means in particular for a programme covering one or more schemes as referred to in Article 5(4) of Regulation (EU) No 1144/2014, to focus on the scheme or schemes in the main message of the campaign. When in this programme, one or several products illustrate the scheme or schemes, they shall appear as a secondary message in relation to the main message of the campaign;]

2. In addition, if a message conveyed by a programme concerns information on the impact on health, this message shall:

(a) in the [F4 United Kingdom], comply with the Annex to Regulation (EC) No 1924/2006, or be accepted by the [F5 relevant authority] responsible for public health in the [F6 constituent nation] where the operations are carried out;

(b) in third countries, be accepted by the national authority responsible for public health in the country where the operations are carried out.

[F7 3. In this Article, “relevant authority” means—

• — in relation to England, the Secretary of State;

• — in relation to Wales, the Welsh Ministers;

• — in relation to Scotland, the Scottish Ministers;

• — in relation to Northern Ireland, the Department of Health.]
