Transfer of certain functions of Department of the Environment

4.—(1) The functions which immediately before the transfer date are exercisable by the Department of the Environment under or for the purposes of—

(a) sections 109A, 116 and 116B to 116D of the Social Security Administration (Northern Ireland) Act 1992(1); and

(b) sections 122 and 122B to 122E of the Social Security Administration Act 1992(2),

are hereby transferred as from that date to the Department of Finance and Personnel.

(2) The functions which immediately before the transfer date are exercisable by the Department of the Environment under or for the purposes of—

(a) section 11 of the Transport Act (Northern Ireland) 1967(3);

(b) the Transport (Amendment) Act (Northern Ireland) 1971(4);

(c) the Transport (Northern Ireland) Order 1977(5), except Article 10; and

(d) Articles 31, 33(3), 45 and 50 of the Road Traffic (Northern Ireland) Order 1995(6),

are hereby transferred as from that date to the Department for Regional Development.

(3) The functions which immediately before the transfer date are exercisable by the Department of the Environment under or for the purposes of—

(a) Article 8(1)(b), (2) and (7) of, and paragraphs 1 and 2 of Schedule 1 to, the Water and Sewerage Services (Northern Ireland) Order 1973(7);

(b) Articles 110, 111(1) to (3) and (5) and 127(1)(c) of the Planning (Northern Ireland) Order 1991(8); and

(c) paragraph 3(2)(b) and (3) of Schedule 1 to the Water (Northern Ireland) Order 1999(9),

are hereby transferred as from that date to the Office of the First Minister and deputy First Minister.
