38.—(1) The Health and Personal Social Services (General Medical Services Contracts) Regulations (Northern Ireland) 2004(1) are amended as follows.
(2) In regulation 5(2) (general conditions relating to all contracts)–
(a)After sub-paragraph (i) insert—
“(ia)become a person in relation to whom a moratorium period under a debt relief order made under Part 7A of the Insolvency Act 1986 or Part 7A of the Insolvency (Northern Ireland) Order 1989 applies;”
(b)In sub-paragraph (i)(ii) after “Insolvency (Northern Ireland) Order 1989” insert “or a debt relief restrictions order or an interim debt relief restrictions order under Schedule 4ZB to the Insolvency Act 1986 or Schedule 2ZB to the Insolvency (Northern Ireland) Order 1989”.
(3) In paragraph 105(2)(j)(ii) of Schedule 5 (other contractual terms)–
(a)After sub-paragraph (2)(j)(i) insert—
“(ai)become a person in relation to whom a moratorium period under a debt relief order applies;”.
(b)In sub-paragraph (2)(j)(ii) after “Insolvency (Northern Ireland) Order 1989” insert “or a debt relief restrictions order or an interim debt relief restrictions order under Schedule 4ZB to the Insolvency Act 1986 or Schedule 2ZB to the Insolvency (Northern Ireland) Order 1989”.
