22. The following provisions of the Seeds Act (Northern Ireland) 1965(1) shall apply for the purpose of these Regulations as they apply for the purposes of seeds regulations having effect under that Act and, unless the context otherwise requires, any reference in them to seeds regulations or to that Act shall be construed as references to these Regulations—
section 8 (powers of entry);
section 9 (use of samples in criminal proceedings);
section 10 (tampering with samples);
section 11 (institution of criminal proceedings), subject to the modification that it shall apply to proceedings in respect of any offence under these Regulations as it applies to the proceedings to which it refers;
section 12(1) (application of the Act to seed potatoes); and
section 14(2) (interpretation: contravention and failure of compliance).
1965, c.22 (N.I.). Section 1 was amended by 1970 c. 20 (N.I.), section 10(1) and S.R. & O. (N. I.) 1972 No. 351, Article 3 and Schedule 3. Section 2 was amended by 1970 c. 20 (N.I.), section 10(2) and S.R. 1977 No. 295, regulation 2. The Ministry of Agriculture became known as the Department of Agriculture by virtue of section 7(5) of the Northern Ireland Constitution Act 1973 (c.36). The Department of Agriculture for Northern Ireland was renamed the Department of Agriculture and Rural Development by Article 3(4) of the Departments (Northern Ireland) Order 1999, S.I. 1999/283 (N.I. 1). The Department of Agriculture and Rural Development was renamed the Department of Agriculture, Environment and Rural Affairs by Article 1(2) of the Departments Act (Northern Ireland) 2016 (2016 c. 5 (N.I.).
