Amendments to the Criminal Proceedings etc. (Reform) (Scotland) Act 2007 (Commencement No. 2 and Transitional Provisions and Savings) Order 2007

2.—(1) The Criminal Proceedings etc. (Reform) (Scotland) Act 2007 (Commencement No. 2 and Transitional Provisions and Savings) Order 2007(1) is amended in accordance with this article.

(2) In article 3(1) for “the Act” substitute “the 2007 Act”.

(3) In article 4(2) after “section 27(1)” insert “or (7)”.

(4) In article 9 after “where” insert “, at 10th December 2007,”.

(5) In column 1 of the Schedule–

(a) in the heading, for “the Act” substitute “the 2007 Act”; and

(b) after the words “Schedule, paragraph 5”, insert a new row containing the words “Schedule, paragraph 9(7) but only insofar as it applies to justices of the peace”.

(6) In column 2 of the Schedule–

(a) where it appears opposite the reference to “Schedule, paragraph 1” contained in column 1, for “Legal Officer” substitute “Legal Officers”;

(b) after the words “Minor and consequential amendments relating to the Legal Aid (Scotland) Act 1986”, insert a new row containing the words “Minor and consequential amendments relating to section 9A (competence of justice’s actings outwith jurisdiction) of the 1995 Act”; and

(c) where it appears opposite the reference to “Schedule, paragraph 29” contained in column 1, for “the Public Appointments and Public Bodies Act 2003” substitute “the Public Appointments and Public Bodies etc. (Scotland) Act 2003”.
