3.—(1) The amendments made by article 2 are of no effect in respect of a person being given medical treatment in hospital by virtue of a relevant order under the Criminal Procedure (Scotland) Act 1995(1) (“the 1995 Act”).
(2) In paragraph (1), a “relevant order” is an order under section 228(2) of the 1995 Act which includes a requirement by virtue of section 230 of that Act to submit to treatment as a resident patient in hospital or as a non-resident patient at an institution or place specified in the order.
Sections 228 and 230 were repealed by the 2010 Act, schedule 2, paragraph 17; the repeal has effect subject to savings provisions specified in S.S.I. 2010/413.
