3. In regulation 4(1) (interpretation)—
(a)after the definition of “adoption leave” insert—
““adult disability payment” means—
disability assistance for adults given in accordance with the Disability Assistance for Working Age People (Scotland) Regulations 2022(1), and
where short-term assistance is being given under Part 1 of schedule 2 (short-term assistance) of those Regulations, the “earlier determination” referred to in paragraph 1(1)(a) of that schedule is to be deemed to continue in payment for the purposes of these Regulations,”,
(b)after the definition of “attendance allowance” insert—
““award of universal credit” includes a universal credit award with a value of zero,”,
(c)for the definition of “blind” substitute—
““blind” means—
in relation to a child, certified as severely sight impaired by the child’s ophthalmologist, orthoptist, optometrist or visual impairment paediatrician,
in relation to a person 16 years of age or over, certified as severely sight impaired or blind by a consultant ophthalmologist”,
(d)in the definition of “employment and support allowance” after “Act” insert “(removing references to an income-based allowance)”.
