4.  In regulation 7 (when a person is responsible for a child or young person)—

(a)in paragraph (1), for “Regulation” substitute “Regulations”,

(b)after paragraph (9) insert—

(10) In this Regulation—

(a)“looked after by a local authority” has the meaning given in section 17(6) of the Children (Scotland) Act 1995(1),

(b)“prisoner” means a person who is—

(i)detained in custody pending trial or sentence upon conviction or under a sentence imposed by a court, other than a person who is detained in hospital under the provisions of the Mental Health Care and Treatment (Scotland) Act 2003(2), the Criminal Procedure (Scotland) Act 1995(3), the Mental Health Act 1983(4) or the Mental Health (Northern Ireland) Order 1986(5), or

(ii)on temporary release from a detention mentioned under sub-paragraph (a) in accordance with rules made under the Prisons (Scotland) Act 1989(6), the Prison Act 1952(7) or the Prison Act (Northern Ireland) 1953(8)..
