Employers’ Liability (Compulsory Insurance) Act 1969

3 Employers exempted from insurance. E+W+S

(1) This Act shall not require any insurance to be effected by—

(a) any such authority as is mentioned in subsection (2) below; or

(b) any body corporate established by or under any enactment for the carrying on of any industry or part of an industry, or of any undertaking, under national ownership or control; or

(c) in relation to any such cases as may be specified in the regulations, any employer exempted by regulations.

(2) The authorities referred to in subsection (1)(a) above are

[F1 (a) a health service body, as defined in section 60(7) of the National Health Service and Community Care Act 1990, [F2 [F3 NHS England] [F4 , an integrated care board established under section 14Z25] of the National Health Service Act 2006,]F5 ... a National Health Service trust established under [F6 section 25 of the National Health Service Act 2006, section 18 of the National Health Service (Wales) Act 2006 ] or the National Health Service (Scotland) Act [F7 1978, ] [F8 an NHS foundation trust] F9 ... [F10 and a Local Health Board established under [F11 section 11 of the National Health Service (Wales) Act 2006]] and

(b)] the Common Council of the City of London, F12 ... the council of a London borough, the council of a county, F13 ... or [F14 district] in England [F15 the council of a county or county borough in Wales,] [F16 the Broads Authority] [F17 a National Park authority], [F18 a council constituted under section 2 of the Local Government etc. (Scotland) Act 1994 in] Scotland, any joint board or joint committee in England and Wales or joint committee in Scotland which is so constituted as to include among its members representatives of any such council [F19 the Strathclyde Passenger Transport Authority] F20 [F21 ... , any joint authority established by Part IV of the Local Government Act 1985], [F22 an economic prosperity board established under section 88 of the Local Democracy, Economic Development and Construction Act 2009, a combined authority established under section 103 of that Act,] [F23 a combined county authority established under section 9(1) of the Levelling-up and Regeneration Act 2023,] [F24 a fire and rescue authority created by an order under section 4A of the Fire and Rescue Services Act 2004,] F25 ... [F26 the London Fire Commissioner,] [F27 , any local policing body, any chief constable established under section 2 of the Police Reform and Social Responsibility Act 2011, and the Commissioner of Police of the Metropolis[F28 , the Scottish Police Authority and the Scottish Fire and Rescue Service]].[F29 ; and

(c) the Commission for Equality and Human Rights.]
