In this Part of this Act—
“functions” includes powers and duties; and
“relevant authority” means—
in England F1 ., the Secretary of State, [F2a water authority], a county council, . . . F3, a district council, a London borough council, the Common Council of the City of London, the Sub-Treasurer of the Inner Temple and the Under Treasurer of the Middle Temple [F4and, for the purposes of sections 91 to 93 of this Act, a sewerage undertaker]; and
[F5in Wales, the Secretary of State, a county council or a county borough council and, for the purposes of sections 91 to 93 of this Act, a sewerage undertaker; and]
[F6in Scotland—
as respects sections 91 and 92, a council constituted under section 2 of the M1Local Government etc. (Scotland) Act 1994; and
as respects this Part other than those sections, the Secretary of State, SEPA or a council constituted under section 2 of the Local Government etc. (Scotland) Act 1994.]
