(1)Subject to subsection (2) below, [F1sections 238 to 240 of the Town and Country Planning Act 1990] and [F2section 197 of the Town and Country Planning (Scotland) Act 1997] (consecrated land and burial grounds) shall have effect in relation—
(a)to land acquired by the Secretary of State for purposes connected with the exercise of his functions relating to civil aviation, and
(b)to land acquired by the Secretary of State in pursuance of this Part of this Act and otherwise than as mentioned in paragraph (a) above,
as if the Secretary of State had acquired that land under [F1Part IX of the said Act of 1990] or, as the case may be, [F2Part VIII of the said Act of 1997].
(2)[F3The said sections 238 to 240][F4and 197] shall have effect [F5in relation to any land—
(a)acquired by the CAA, or
(b)acquired by a licence holder for purposes connected with the carrying out of the activities authorised by the licence,]
as they have effect in relation to land acquired by statutory undertakers under [F3Part IX of the said Act of 1990] or, as the case may be, [F4Part VIII of the said Act of 1997].
