(2)An appeal [F3to the Upper Tribunal under section 11 of the Tribunals, Courts and Enforcement Act 2007 which arises from any decision of the First-Tier Tribunal made under section 12 of this Act] may be made by—
(a)the Secretary of State,
(b)the person who applied for the certificate of recoverable benefits, F4. . .
