7.[F1(1)] [F2Subject to sub-paragraph (2)] for the purposes of this Part of this Schedule, once a premium is applicable to claimant under this Part, a person shall be treated as being in receipt of any benefit—

(a)in the case of a benefit to which the Social Security (Overlapping Benefits) Regulations 1979 F3 applies, for any period during which, apart from the provisions of those Regulations, he would be in receipt of that benefit; F4...

(b)for any period spent by a person in undertaking a course of training or instruction provided or approved by the [F5Secretary of State F6...] under section 2 of the Employment and Training Act 1973 F7 [F8or by [F9Skills Development Scotland,] Scottish Enterprise or Highlands and Islands Enterprise under section 2 of the Enterprise and New Towns (Scotland) Act 1990,] [F10or for any period during which he is in receipt of a training allowance] [F11and]

[F12(c)in the case of carer support payment, for any period during which, apart from regulation 16 of the Carer’s Assistance (Carer Support Payment) (Scotland) Regulations 2023, he would be in receipt of that benefit.]

[F13(2) For the purposes of the carer premium under paragraph 14ZA, a person shall be treated as being in receipt of [F14carer’s allowance] by virtue of sub-paragraph (1)(a) [F15or carer support payment by virtue of sub-paragraph (1)(c)] only if and for so long as the person in respect of whose care the allowance [F16or payment] has been claimed remains in receipt of attendance allowance [F17, pension age disability payment] [F18, F19... the care component of disability living allowance at the highest or middle rate prescribed in accordance with section 37ZB(3) of the Social Security Act] [F20, the care component of child disability payment at the highest or middle rate prescribed in accordance with the regulation 11(5) of the DACYP Regulations] [F21or the daily living component of personal independence payment at the standard or enhanced rate in accordance with section 78(3) of the 2012 Act] [F22, the daily living component of adult disability payment at the standard or enhanced rate in accordance with regulation 5 of the Disability Assistance for Working Age People (Scotland) Regulations 2022] [F23or armed forces independence payment].]
