3. Section 37(1) of the 1989 Act shall not apply in relation to an electric line which–
(a)has been, or is to be, installed or kept installed in accordance with a power conferred by, or by an order made under, an Act of Parliament; and
(b)has been, or is to be, installed or kept installed for the purposes of a tramway or trolley vehicle system or system using a mode of guided transport prescribed by order made under section 2 of the 1992 Act or authorised by an Act of Parliament passed to confirm an order made under the Private Legislation Procedure (Scotland) Act 1936(1).
