8.—(1) This regulation applies to discharges of biodegradable industrial waste water from plants representing 4,000 p.e. or more belonging to the industrial sectors listed in Schedule 5 which does not enter urban waste water treatment plants before discharge to receiving waters.
[F1(2) The Environment Agency [F2or, as the case may be, the Natural Resources Body for Wales] must impose, in every environmental permit with respect to any discharge on or after 31st December 2000 to which this regulation applies, conditions which are appropriate to the nature of the industry concerned for the discharge of such waste water.]

(4) All lakes and ponds shall be treated as controlled waters for the purposes of the enactments mentioned in [F4paragraph (2)] above insofar as they relate to discharges to which this regulation applies.
