3. The amendment of section 49(3) of the Education (No. 2) Act 1986(1) (appraisal of performance of teachers) by paragraph 14 of Schedule 30 to the 1998 Act shall only apply in relation to regulations under the said section 49 which are made to come into effect on or after 1st September 1999 and shall not affect the operation prior to that date of regulations made under that section in its unamended form.
