Amendments to Civil Procedure Rules 1998

25.  In RSC Order 94—

(a)for rule 8, substitute—

8.(1) A person who was a party to proceedings before any such tribunal as is mentioned in section 11(1) of the Tribunals and Inquiries Act 1992(1) and is dissatisfied in point of law with the decision of the tribunal may appeal to the High Court.

(2) The appellant’s notice must be served—

(a)on the chairman of the tribunal;

(b)in the case of a tribunal which has no chairman or member who acts as a chairman, on the member or members of that tribunal; or

(c)in the case of any such tribunal as is specified in paragraph 16 of Schedule 1 to the said Act of 1992, on the secretary of the tribunal.

(3) Where an appeal is against the decision of a tribunal constituted under section 46 of the National Health Service Act 1977(2) the appellants’s notice must be filed at the High Court within 14 days after the date of that decision.

(4) Where an appeal is against the decision of a tribunal established under section 1 of the Employment Tribunals Act 1996(3) the appellant’s notice must be filed at the High Court within 42 days after the date of that decision.;

(b)in rule 12 for “claim form”, wherever it occurs, substitute “appellant’s notice”; and

(c)in rule 13—

(i)in paragraph (5) for “claim form”, substitute “appellant’s notice”; and

(ii)omit paragraph (8).
