1.—(1) This Order may be cited as the Social Security Benefits Up-rating Order 2000.
(2) Subject to paragraphs (3) to (6) of this article, this Order shall come into force for the purposes of–
(a)articles 1, 2, 6, 20 and 24, on 1st April 2000;
(b)article 8, in so far as it relates to a particular beneficiary, on the first day of the first benefit week to commence for that beneficiary on or after 1st April 2000, and for the purpose of this sub-paragraph, “benefit week” has the same meaning as in the Computation of Earnings Regulations;
(c)articles 3 to 5, 7 and 11 to 13, on 10th April 2000;
(d)article 9, on 6th April 2000;
(e)article 10, on 2nd April 2000;
(f)articles 14 and 15, on 13th April 2000;
(g)articles 16 to 18, in so far as they relate to a particular beneficiary, on the first day of the first benefit week to commence for that beneficiary on or after 10th April 2000, and for the purpose of this sub-paragraph, “ benefit week” has the same meaning as in the Income Support Regulations;
(h)article 19, in relation to a case where rent is payable at intervals of a week or any multiple thereof, on 3rd April 2000, and in relation to any other case, on 1st April 2000;
(i)articles 21 to 23, in so far as they relate to a particular beneficiary, on the first day of the first benefit week to commence for that beneficiary on or after 10th April 2000, and for the purpose of this sub-paragraph, “ benefit week” has the same meaning as in the Jobseeker’s Allowance Regulations.
(3) The increases made–
(a)in the sums specified for rates or amounts of benefit under the Contributions and Benefits Act or the Pension Schemes Act; and
(b)by article 21(c) of this Order in so far as it is relevant for the purposes referred to in article 6(11) of this Order,
shall take effect for each case on the date specified in relation to that case in article 6 of this Order.
(4) Subject to paragraph (5) below, in so far as articles 16(3), 19(6), 20(5) and 22(3) of this Order amend the provisions specified in paragraph (6) below (which specify the personal allowances to be applied in respect of children and young persons when calculating applicable amounts), it shall come into force immediately after the coming into force of regulation 2(1)(b) of the Social Security Amendment (Personal Allowances for Children and Young Persons) Regulations 1999(1).
(5) Where, in relation to a particular beneficiary–
(a)Both paragraph (4) and either or both of paragraphs (2)(g) and (i) above apply; and
(b)the coming into force dates specified in relation to those provisions would not coincide,
then, in such a case, the coming into force date for the purposes of paragraph (4) shall instead be the first day of the first benefit week to commence for that beneficiary after 10th April 2000.
(6) The provisions specified for the purposes of paragraph (4) are–
(a)paragraph 2(1) of Schedule 1 to the Council Tax Benefit Regulations (2);
(b)paragraph 2(1) of Schedule 2 to the Housing Benefit Regulations (3);
(c)paragraph 2(1) of Schedule 2 to the Income Support Regulations (4); and
(d)paragraph 2(1) of Schedule 1 to the Jobseeker’s Allowance Regulations (5).
