1.—(1) Section 121A(1) of the Road Traffic Regulation Act 1984 (traffic authorities) is amended as follows.
(2) In subsection (1)–
(a)“(a)”; and
(b)paragraph (b)(2) and the word “and” preceding it,
shall cease to have effect.
(3) After subsection (1) there is inserted–
“(1AA) The roads authority (as defined in section 151(1) of the Roads (Scotland) Act 1984(3)) is the traffic authority for every road in Scotland.”.
(4) Subsections (1A)(4) and (4) shall cease to have effect.
(5) In subsection (5)–
(a)after “than” there is inserted–
“(a)in relation to England and Wales,”; and
(b)at the end there is inserted–
“; or
(b)in relation to Scotland, the Secretary of State or the Scottish Ministers.”.
Section 121A was inserted by the New Roads and Street Works Act 1991, Schedule 8, paragraph 70.
Paragraph (b) was substituted by the Scotland Act (Consequential Modifications) (No. 2) Order 1999 (S.I. 1999/1820), Schedule 2, paragraph 73.
