Pensions to which the 1971 Act will apply

3.—(1) The 1971 Act shall have effect in relation to—

(a) any pension payable under the Armed Forces Pension Scheme 2005 (being a scheme made under section 1(1) of the Armed Forces (Pensions and Compensation) Act 2004(1)); and

(b) any pension payable under the Reserve Forces Pension Scheme 2005 (being a scheme made under sections 4 and 8 of the Reserve Forces Act 1996(2));

as if it were a pension specified in Part I of Schedule 2 to the 1971 Act.

(2) The 1971 Act shall have effect in relation to any pension payable by a conservation board under a scheme made under section 7 of the Superannuation Act 1972(3) (being the enabling power under which pension schemes are made for persons employed in local government service) as if it were a pension specified in Part II of Schedule 2 to the 1971 Act.
