41. For the purposes of section 3 of the Freedom of Information Act 2000 (public authorities)(1), while Bradford & Bingley is wholly owned by the Treasury, a relevant undertaking shall be deemed—
(a)not to be a publicly-owned company for the purposes of subsection (1)(b);
(b)not to hold information on behalf of the Treasury for the purposes of subsection (2)(b).
