Article 5
1. In section 1(2)(1) of the Chartered Associations (Protection of Names and Uniforms) Act 1926 for “Lord Chancellor” (wherever occurring) substitute “Lord President of the Council”.
2. At the beginning of Part 5 of the Representation of the People Act 1983 insert—
“199ZA. Functions of the Lord President of the Council
See the Lord President of the Council Order 2010 by virtue of which functions of the Secretary of State under this Act are exercisable concurrently with the Lord President of the Council.”
3. After section 27(2) of the Representation of the People Act 1985 insert—
“(2ZA) See the Lord President of the Council Order 2010 by virtue of which functions of the Secretary of State under this Act are exercisable concurrently with the Lord President of the Council.”
4. Before section 7 of the Parliamentary Constituencies Act 1986 insert—
See the Lord President of the Council Order 2010 by virtue of which functions of the Secretary of State under this Act are exercisable concurrently with the Lord President of the Council.”
5. In section 2(4)(2) of the Lieutenancies Act 1997 for “Lord Chancellor” substitute “Lord President of the Council”.
6. In section 17A(3) and (6)(3) of the Greater London Authority Act 1999 after “Secretary of State” insert “or the Lord President of the Council”.
7. After section 16 of the Representation of the People Act 2000 insert—
See the Lord President of the Council Order 2010 by virtue of which functions of the Secretary of State under this Act are exercisable concurrently with the Lord President of the Council.”
8. At the end of Part 2 of the Local Government Act 2000 insert—
“48A. Functions of the Lord President of the Council
See the Lord President of the Council Order 2010 by virtue of which functions of the Secretary of State under sections 44 and 45 are exercisable concurrently with the Lord President of the Council.”
9. In the following provisions of the Political Parties, Elections and Referendums Act 2000 for “Lord Chancellor” substitute “Lord President of the Council”—
(a)section 2(2)(b)(4);
(b)section 159A(5) and the heading to that section;
(c)paragraph 2(1)(c) of Schedule 2(6).
10. Before section 17 of the European Parliamentary Elections Act 2002 insert—
See the Lord President of the Council Order 2010 by virtue of which functions of the Secretary of State under this Act are exercisable concurrently with the Lord President of the Council.”
11. Before section 27 of the European Parliament (Representation) Act 2003 insert—
See the Lord President of the Council Order 2010 by virtue of which functions of the Secretary of State under this Act are exercisable concurrently with the Lord President of the Council.”
12. After section 74 of the Electoral Administration Act 2006 insert—
See the Lord President of the Council Order 2010 by virtue of which functions of the Secretary of State under this Act are exercisable concurrently with the Lord President of the Council.”
13. After section 38 of the Political Parties and Elections Act 2009 insert—
“38A. Functions of the Lord President of the Council
See the Lord President of the Council Order 2010 by virtue of which functions of the Secretary of State under this Act are exercisable concurrently with the Lord President of the Council.”
Section 1(2) was amended by S.I. 2001/3500, Sch. 2.
Section 2(4) was amended by S.I. 2001/3500, Sch. 2. By virtue of S.I. 1999/1750, the functions of a Minister of the Crown under section 2(4) are exercisable by the Scottish Ministers in or as regards Scotland.
Section 17A was inserted by the Representation of the People Act 2000 (c. 2), s. 14. Section 17A(3) was amended by S.I. 2001/648, Sch. 1.
Section 2(2)(b) was amended by S.I. 2002/2626, Sch. 2.
