Minimum level of loan for living costs E+W

105.—(1) F1 Subject to paragraphs (2) and (7), for a student other than a 2009 [F2 , 2012 or 2016] cohort student, the “minimum level for the academic year” in regulations 72(5) ... and 104(d) is—

(a) [F3 £3,668], in the case of a student in category A;

(b) [F4 £6,641], in the case of a student in category B;

(c) [F5 £5,652], in the case of a student in category C;

(d) [F6 £4,743], in the case of a student in category D.

(2) F7 Subject to paragraph (7), for a student other than a 2009 [F8 , 2012 or 2016] cohort student, where the academic year in question is the final year of a course other than an intensive course, the “minimum level for the academic year” in regulations 72(5) ...and 104(d) is—

(a) [F9 £3,318], in the case of a student in category A;

(b) [F10 £6,048], in the case of a student in category B;

(c) [F11 £4,914], in the case of a student in category C;

(d) [F12 £4,389], in the case of a student in category D.

(3) Subject to paragraphs (4) and (7), for a 2009 cohort student the “minimum level for the academic year” [F13 in regulation 74(5)] is—

(a) [F14 £3,684], in the case of a student in category A;

(b) [F15 £6,649], in the case of a student in category B;

(c) [F16 £5,656], in the case of a student in category C;

(d) [F17 £4,751], in the case of a student in category D.

(4) Subject to paragraph (7), for a 2009 cohort student where the academic year in question is the final year of a course other than an intensive course, the “minimum level for the academic year” [F18 in regulation 74(5)] is—

(a) [F19 £3,343], in the case of a student in category A;

(b) [F20 £6,053], in the case of a student in category B;

(c) [F21 £4,918], in the case of a student in category C;

(d) [F22 £4,398], in the case of a student in category D.

(5) Subject to paragraphs (6) and (7), for a 2012 cohort student, the “minimum level for the academic year” in regulations 76 and 104(d) is—

(a) [F23 £3,790], in the case of a student in category A;

(b) [F24 £6,649], in the case of a student in category B;

(c) [F25 £5,664], in the case of a student in category C;

(d) [F26 £4,769], in the case of a student in category D.

(6) Subject to paragraph (7), for a 2012 cohort student, where the academic year in question is the final year of a course other than an intensive course, the “minimum level for the academic year” in regulations 76 and 104(d) is—

(a) [F27 £3,482], in the case of a student in category A;

(b) [F28 £6,056], in the case of a student in category B;

(c) [F29 £4,921], in the case of a student in category C;

(d) [F30 £4,433], in the case of a student in category D.

[F31 (6A) Subject to paragraphs (6B) and (7), for a 2016 cohort student who satisfies all the conditions in regulation 71(1)(g), the “minimum level for the academic year” in regulation 80A is—

(a) [F32 £3,790], in the case of a student in category A;

(b) [F33 £6,647], in the case of a student in category B;

(c) [F34 £5,662], in the case of a student in category C;

(d) [F35 £4,767], in the case of a student in category D.

(6B) Subject to paragraph (7), for a 2016 cohort student who satisfies all the conditions in regulation 71(1)(g), where the academic year in question is the final year of a course other than an intensive course, the “minimum level for the academic year” in regulation 80A is—

(a) [F36 £3,482], in the case of a student in category A;

(b) [F37 £6,056], in the case of a student in category B;

(c) [F38 £4,920], in the case of a student in category C;

(d) [F39 £4,432], in the case of a student in category D.

(6C) Subject to paragraphs (6D) and (7), for a 2016 cohort student who satisfies all the conditions in regulation 71(1)(h), the “minimum level for the academic year” in regulation 80B is—

(a) [F40 £3,790], in the case of a student in category A;

(b) [F41 £6,647], in the case of a student in category B;

(c) [F42 £5,662], in the case of a student in category C;

(d) [F43 £4,767], in the case of a student in category D.

(6D) Subject to paragraph (7), for a 2016 cohort student who satisfies all the conditions in regulation 71(1)(h), where the academic year in question is the final year of a course other than an intensive course, the “minimum level for the academic year” in regulation 80B is—

(a) [F44 £3,482], in the case of a student in category A;

(b) [F45 £6,056], in the case of a student in category B;

(c) [F46 £4,920], in the case of a student in category C;

(d) [F47 £4,432], in the case of a student in category D.]

(7) Where different categories apply for different quarters of the academic year, the minimum levels in paragraphs [F48 (1) to (6D)] are the aggregate of the amounts determined under paragraph (8) for each of the quarters in respect of which a loan is payable.

(8) The amount determined for each quarter is one third of the amount in paragraph (1), (2), (3), (4), (5) [F49 , (6), (6A), (6B), (6C) or (6D)] which corresponds to the rate applicable for the quarter.

(9) The rate applicable for a quarter is determined in accordance with regulation 83.

(10) Categories A to D have the meaning given in regulation 90.
