39.—(1) The Police Reform Act 2002(1) is modified as follows.
(2) In section 82 (Nationality requirements applicable to police officers etc.)(2)—
(a)in subsection (1)—
(i)in paragraph (a) omit “or Scotland”; and
(ii)after that paragraph insert—
“(aa)a constable of the Police Service of Scotland;”;
(b)at the end of subsection (2)(a), omit “or” and insert—
“(aa)the Police Service of Scotland; or”; and
(c)in subsection (3)(b) for “section 26” to the end substitute “section 48 of the Police and Fire Reform (Scotland) Act 2012 (governance and administration of police)”.
(3) Omit section 103(4) and (7) (liability in respect of members of teams).
(4) In paragraph 6(2)(b) of Schedule 2 (Independent Police Complaints Commission) for “any police force maintained for a police area in Scotland” substitute “the Police Service of Scotland”.
Section 82 is relevantly amended by the Energy Act 2004 (c.20), Schedule 14, paragraph 11(a) and the Serious Organised Crime and Police Act 2005 (c.15), Schedule 17, paragraph 1.
