Amendments to the Railways and Other Guided Transport Systems (Safety) Regulations 2006

2.—(1) The Railways and Other Guided Transport Systems (Safety) Regulations 2006(1) are amended as follows.

(2) In regulation 2 (interpretation and application), in paragraph (1) for the definition of “the Directive” substitute—

““the Directive” means Directive 2004/49/EC of the European Parliament and of the Council on safety on the Community’s railways and amending Council Directive 95/18/EC on the licensing of railway undertakings and Directive 2001/14/EC on the allocation of railway infrastructure capacity and the levying of charges for the use of railway infrastructure and safety certification(2) as amended by—

(a)

the Interoperability Directive(3);

(b)

Directive 2008/110/EC of the European Parliament and of the Council amending Directive 2004/49/EC on safety on the Community’s railways(4);

(c)

Commission Directive 2009/149/EC amending Directive 2004/49/EC of the European Parliament and of the Council as regards Common Safety Indicators and common methods to calculate accident costs(5); and

(d)

Commission Directive 2014/88/EU amending Directive 2004/49/EC of the European Parliament and of the Council as regards common safety indicators and common methods of calculating accident costs(6);”

(3) In regulation 20(1)(c) for “Schedule 3” substitute “Annex I (common safety indicators) of the Directive(7),”.

(4) Omit Schedule 3 (common safety indicators).
