46.—(1) Regulation 123(2B) (further limitations on the use of planning obligations) of the Community Infrastructure Levy Regulations 2010(1) is amended as follows.
(2) Omit the “or” at the end of sub-paragraph (a).
(3) At the end of sub-paragraph (b) insert—
“; or
(c)a strategic highways company for the time being appointed under Part 1 of the Infrastructure Act 2015(2)”.
