2.—(1) The M20 Junction 10a Development Consent Order 2017 is amended as follows.
(2) In paragraph 3(2) of Schedule 2 (requirements)—
(a)in paragraph (e)—
(i)before “require” insert “subject to paragraph (ea),”;
(ii)for “18:00” substitute “19:00”; and
(iii)for “13:00” substitute “18:00”; and
(b)after paragraph (e) insert—
“(ea)not permit any works to be carried out on Sundays or Bank Holidays except for—
(i)works which are exclusively earthworks (including soil stripping and storage, site levelling) provided that adherence is required to working hours of 08:00 to 17:00; or
(ii)works specified in sub-paragraphs (i) to (vii) of paragraph (e);”.
(3) After paragraph 3(5) insert—
“(6) In this paragraph “Bank Holiday” means a day that is a Bank Holiday in England and Wales under section 1 of the Banking and Financial Dealings Act 1971(1).”.
