50.—(1) Section 194A of the Communications Act 2003(1) is amended as follows.

(2) In subsection (2B)(2)—

(a)for “retained”, in the first place it appears, substitute “assimilated”;

(b)omit “or retained general principle of EU law”.

(3) In subsection (6)(3)—

(a)at the appropriate place insert—

assimilated case law” has the meaning given by section 6(7) of the European Union (Withdrawal) Act 2018;;

(b)omit the definitions of “retained case law” and “retained general principle of EU law”.

Subsection (2B) was inserted by section 13(2) of the Telecommunications (Security) Act 2021 (c. 31).

(3)

The definitions of “retained case law” and “retained general principle of EU law” were inserted by section 13(3) of the Telecommunications (Security) Act 2021 (c. 31).
